General Rental Conditions (GTC)
These General Rental Conditions govern the provision of containers by Eurocontex to its tenants (individuals or professionals) within the European Union.
1. Formation of the lease agreement
The rental agreement is concluded upon acceptance of the quote or order form by the tenant and payment of the security deposit. The minimum rental period is specified in the contract. Eurocontex retains ownership of the rented container at all times.
2. Security Deposit
A security deposit equivalent to six weeks/months' rent is required upon signing the contract. This deposit will be returned within a maximum of 30 days following the return of the container, less any repair costs attributable to the tenant.
3. Rent and payment terms
Rent is payable monthly or according to the agreed schedule, either in arrears or in advance as agreed. Any late payment will incur late payment interest in accordance with Directive 2011/7/EU.
4. Tenant's Obligations
The tenant agrees to:
• Use the container in accordance with its intended purpose and technical specifications.
• Maintain the container in good working order.
• Do not sublet, transfer, or pledge the container without written authorization from Eurocontex.
• Allow Eurocontex access to the container for inspection with reasonable notice
• Inform Eurocontex immediately of any damage, loss or theft
• Comply with local regulations regarding container storage and placement.
• Take out insurance covering the container against the risks of fire, theft, damage and civil liability
5. Eurocontex Bonds
Eurocontex is committed to:
• Deliver a container that conforms to the agreed specifications and is in good condition.
• Ensure the structural maintenance of the container
• To intervene within a reasonable timeframe in the event of a default not attributable to the tenant
6. Termination
The contract may be terminated in the following cases:
• At the tenant's initiative: with at least 30 days' written notice, subject to compliance with the minimum commitment period.
• At the initiative of Eurocontex: in the event of serious breach by the tenant (non-payment, misuse, etc.), after a formal notice has been kept without success for 15 days
In the event of early termination attributable to the tenant, the latter remains liable for rent payments up to the initial contractual term.
7. Returning the container
At the end of the contract, the tenant must return the container in the same condition as when received, taking into account normal wear and tear. A joint inspection report will be drawn up upon delivery and return. The tenant will be responsible for any costs associated with repairs or damage beyond normal wear and tear.
8. Liability and insurance
The renter is responsible for any loss or damage to the container during the rental period. It is their responsibility to obtain adequate insurance. Eurocontex cannot be held liable for any damage caused to third parties by the renter during the use of the container.
